You have the right to withdraw from this contract within one month without giving any reason.

The withdrawal period is one month from the day

on which you, or a third party designated by you other than the carrier, take possession of the goods, if you have ordered one or more goods as part of a single order and they are delivered together;
on which you, or a third party designated by you other than the carrier, take possession of the last item, if you have ordered several goods as part of a single order and they are delivered separately;

To exercise your right of withdrawal, you must inform us (eQuatorial GmbH, Obere Hauptstraße 264, 67363 Lustadt, telephone: +49-6347-6060030, email address: support@drakensberg.de) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not compulsory.

You can also exercise your right of withdrawal online using an appropriately labelled button ("Withdraw from contract" or similar wording) on our website (www.drakensberg.de). If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without delay, containing information about the content of the withdrawal statement and the date and time of its receipt.

You can also electronically fill in and submit the model withdrawal form or any other unequivocal statement on our website (www.drakensberg.de). If you use this option, we will send you an acknowledgement of receipt of your withdrawal without delay (e.g. by email).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we receive notification of your withdrawal from this contract. We will make the reimbursement using the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in any event, you will not incur any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must send back the goods or hand them over to us without undue delay and in any event no later than 14 days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.

We will bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Grounds for exclusion or expiry

The right of withdrawal does not apply to contracts

for the supply of goods that are not prefabricated and whose manufacture is based on an individual choice or decision by the consumer, or that are clearly personalised to the consumer’s needs;
for the supply of goods that are liable to deteriorate or expire rapidly;
for the supply of alcoholic beverages whose price was agreed when the contract was concluded, but which can only be delivered at the earliest 30 days after the conclusion of the contract and whose current value depends on market fluctuations beyond the trader’s control;
for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts

for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if they were unsealed after delivery;
for the supply of goods that, after delivery, have become inseparably mixed with other items due to their nature;
for the supply of audio or video recordings or computer software in sealed packaging, if the seal was removed after delivery.
